Before filing an international application, you need a basis, which can be a national trademark registration or an EU trademark, or an application for either. If you already have a UK trademark or an application for it, you can extend it to other countries under the Madrid System.
If you have a national trademark registration or an application in a Madrid System member country, we can help extend it via the relevant authority. The details in your national trademark registration and international application must match. You don’t have to apply for international trademark registration for all goods and services, but only for the same or fewer items.
To file an international application based on your local trademark, submit it online via UKIPO, selecting the countries you want to cover. UKIPO will then forward it to WIPO. Due to Brexit, EU trademarks and international applications involving the EU are subject to specific measures, including automatic conversion of registered trademarks.
If you file your international application within six months of applying for the UK trademark, you can claim priority, starting trademark protection on the same date in all countries covered by the application.
The World Intellectual Property Organization (WIPO) reviews your application to ensure it meets the necessary conditions. Once compliant, your application is registered in the international trademarks database and published in the WIPO Gazette of International Marks. WIPO notifies the relevant authorities in the countries where you've submitted your application.
